Terms of Service

These Terms govern your access to and use of tnm.me, operated by Texas Nationalist Movement, Inc. By accessing or using the Services, you agree to them.

IMPORTANT NOTICE. READ THIS DOCUMENT CAREFULLY. These Terms contain provisions that materially affect your legal rights, including a binding individual arbitration requirement and a class, collective, mass, and representative action waiver (Section 19), a jury-trial waiver (Section 19), a 30-day opt-out from arbitration (Section 19.7), a disclosure that contributions to TNM are not tax-deductible (Section 2), a broad, irrevocable license to TNM for content you submit (Section 10), limitations on TNM’s liability (Section 17), a consent to receive autodialed, prerecorded, and AI-generated calls and texts (Section 9), and a choice of Texas law and Jefferson County, Texas venue (Section 19.1). If you do not agree, do not use the Services.

1. Acceptance, scope, and the property covered

These Terms form a binding agreement between you and Texas Nationalist Movement, Inc., a Texas nonprofit corporation exempt from federal income tax under Internal Revenue Code §501(c)(4), and govern your use of tnm.me and any current or future subdomain, application, account portal, feature, embedded content, API, communication channel, or service delivered through tnm.me (the “Services”). Where TNM publishes property-specific terms, those terms govern that property and these Terms govern tnm.me. By using the Services you agree to these Terms, the Privacy Policy, and the Community Guidelines, each incorporated by reference.

2. Who we are; nondeductibility; separate entities

Statutory nondeductibility disclosure pursuant to 26 U.S.C. §6113: contributions or gifts to Texas Nationalist Movement, Inc. are not deductible as charitable contributions for federal income tax purposes. A portion of membership dues and contributions may be nondeductible as lobbying expenses under §162(e). Any affiliated entity is a separate legal person with its own policies.

3. Eligibility

The Services are intended for adults. You represent that you are at least eighteen (18) years of age, have legal capacity, are not barred from receiving services from a U.S. nonprofit under trade-control or sanctions law, are not located in an embargoed country, and are not acting as the agent or conduit for any foreign national, government, party, or principal. Persons under 18 may not create an account, declare as a Texian, contribute, submit User Content, register for an event, or transact.

4. Accounts

Certain features require an account. You agree to provide accurate, current information, to safeguard your credentials, and to notify TNM immediately of any unauthorized access. Accounts are tied to a single natural person. TNM may verify your identity, Texas residency, contact information, or payment source. You may close your account at any time by writing support@thetnm.org. TNM may suspend, restrict, or terminate your account, with or without notice and without liability, for violation of these Terms or the Community Guidelines, unlawful or harmful conduct, prolonged inactivity, security incidents, non-payment, or discontinuation of the Services. TNM has no reinstatement obligation.

5. Dormancy

If your account remains inactive for twenty-four (24) consecutive months, TNM may suspend, archive, or terminate it, using reasonable efforts to provide email notice first.

6. Declared Texian status

A user who completes the Declaration becomes a Declared Texian. Declared Texian status is a personal political commitment, recorded by name, contact information, and assigned legislative district for the express purpose of organizing public support for a referendum on Texas independence. It is not a contractual entitlement to any benefit, position, vote, asset, or relationship with TNM. It is revocable by you at any time by writing legal@thetnm.org, and by TNM at any time. It does not authorize you to act, speak, contract, fundraise, or represent any position on behalf of TNM except with express written authorization.

7. Memberships, dues, and recurring billing

TNM offers voluntary paid memberships; membership is not required to declare, receive most communications, attend most public events, or participate. Where you enroll in a recurring membership or contribution, TNM discloses the amount, frequency, automatic-renewal nature, and cancellation method before any charge. You may cancel at any time through your account portal or by writing support@thetnm.org; cancellation takes effect at the end of the current billing period. Dues and contributions are non-refundable except for duplicate or erroneous charges, refunds TNM elects to issue, or refunds required by law. Payments are processed by third-party providers, currently including Stripe and Givebutter.

8. Contributions

Contributions are voluntary and support TNM’s general social-welfare and advocacy work. Contributions are not deductible as charitable contributions for federal income tax purposes.By making any contribution, you represent and warrant, under penalty of perjury, that you are a U.S. citizen or lawfully admitted permanent resident, that the contribution is from your own personal funds, that you are not being reimbursed, that you are not a foreign national as defined in the Federal Election Campaign Act (52 U.S.C. §30121), and that you are not acting as a conduit or straw donor.

9. Electronic communications consent

By providing any contact information, you agree to receive electronic and other communications from TNM at any address you provide. By providing a mobile telephone number, you expressly consent to receive autodialed, prerecorded, and AI-generated text messages and voice calls from TNM, its authorized vendors, and TNM-authorized volunteers using peer-to-peer tools. Consent is not a condition of any purchase, contribution, or service. Message and data rates may apply; message frequency varies. Reply STOP to cancel and HELP for help. You may revoke consent at any time by any reasonable method, processed within ten (10) business days. TNM intends compliance with the Texas Telephone Solicitation Act and the Texas Mini-TCPA to the extent applicable to a 501(c)(4) nonprofit.

10. User content

User Content means anything you submit through the Services. You retain ownership, subject to the license you grant TNM. By submitting User Content, you grant TNM and its affiliates, contractors, service providers, successors, and assigns a perpetual, irrevocable, worldwide, royalty-free, fully paid, non-exclusive, sublicensable, and transferable licenseto host, store, reproduce, modify, adapt, translate, publish, publicly display and perform, broadcast, distribute, and otherwise use your User Content in any media now known or later developed, in connection with operating, marketing, and improving the Services and advancing the mission of TNM, including the right to use your name, voice, image, likeness, and biographical information. You grant TNM the right to use your User Content to train, fine-tune, evaluate, and improve TNM’s own AI and machine-learning systems; you do not grant any unaffiliated third party the right to use your User Content for AI training. You represent that you own or have obtained all rights necessary to grant this license and that your User Content is lawful. TNM may refuse, remove, or edit any User Content in its sole discretion and operates the Services as an interactive computer service under 47 U.S.C. §230.

11. Acceptable use

You agree not to use the Services to violate any law or third-party right; post unlawful, threatening, harassing, defamatory, obscene, hateful, or violence-inciting content; harass, dox, stalk, or impersonate any person; attack, probe, or gain unauthorized access to the Services; circumvent any security or rate-limit measure; use any robot, scraper, or automated means to access or collect data; harvest or compile supporter information in bulk; use any content to train an AI model without TNM’s written consent; send unsolicited bulk communication; solicit for non-TNM causes using TNM’s name or contacts; misrepresent authorization to act for TNM; submit false or synthetic information; or misuse TNM supporter, member, donor, or district data. Liquidated damages of one hundred U.S. dollars per supporter record unlawfully accessed, exported, used, shared, or commercialized apply, in addition to any other remedy. A violation of the Community Guidelines is a violation of these Terms.

12. Intellectual property

The Services and their content (other than User Content) are owned by TNM or its licensors. TNM asserts common-law trademark and service-mark rights in marks including Texas Nationalist Movement, TNM, TEXIT, Texian, Declared Texian, and the associated logos and slogans, enforceable under Section 43(a) of the Lanham Act (15 U.S.C. §1125(a)) and Texas common law. TNM grants you a personal, non-exclusive, non-transferable, revocable, limited license to access and use the Services for your personal, non-commercial use only. You may not use any TNM mark without TNM’s prior written consent.

13. DMCA copyright policy

TNM follows the Digital Millennium Copyright Act, 17 U.S.C. §512. Send infringement notices containing all elements required by §512(c)(3) to the DMCA Designated Agent, Texas Nationalist Movement, Inc., Attn: DMCA Agent, P.O. Box 403, Nederland, Texas 77627, dmca@thetnm.org. TNM terminates the accounts of repeat infringers.

14. Third-party services and links

The Services link to, embed, and integrate with third-party platforms under their own terms and privacy policies. TNM is not responsible for any third-party service, content, accuracy, security, availability, or practice. A link or embed does not constitute endorsement.

15. Volunteers; events; offline activity

County Coordinators, District Captains, Regional Directors, and other field personnel are independent participants, not employees or general agents of TNM. Participation in TNM-organized or TNM-related events involves inherent risks, which you assume; you waive and release TNM and the TNM Released Parties from claims arising from those risks except those arising from TNM’s gross negligence or intentional misconduct. By attending a TNM event you grant TNM the license in Section 10 with respect to your image, likeness, voice, and presence.

16. Disclaimers

The Services, all content, and all features are provided “as is,” “as available,” and “with all faults.” To the maximum extent permitted by law, TNM disclaims all warranties, express, implied, or statutory, including merchantability, fitness for a particular purpose, title, and non-infringement. Statements concerning Texas independence, political strategy, legislative or election outcomes, the timing of any referendum, or any other future event are advocacy, analysis, opinion, or prediction, not guarantees. TNM is committed to accessibility; to request an accommodation or report an issue, write accessibility@thetnm.org (see also our Accessibility statement).

17. Limitation of liability

To the maximum extent permitted by law, TNM and the TNM Released Parties will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, and the total aggregate liability of TNM for all claims will not exceed the greater of the total amount you paid TNM in the twelve (12) months preceding the event giving rise to the claim, or one hundred U.S. dollars (US$100.00). These limitations are a fundamental basis of the bargain.

18. Indemnification

You agree to defend, indemnify, and hold harmless Texas Nationalist Movement, Inc. and its directors, officers, employees, volunteers, contractors, agents, members, affiliates, licensors, service providers, successors, and assigns (the “TNM Released Parties”) from any claims arising out of your use of the Services, your User Content, your violation of these Terms or any law or third-party right, your interaction with any other user, or your statement or action in connection with TNM.

19. Disputes; arbitration; class-action waiver; jury-trial waiver

Read this Section carefully. It requires you and TNM to resolve disputes by binding individual arbitration, waives your right to participate in a class, collective, mass, or representative proceeding, and waives your right to a jury trial. Section 19.7 provides a 30-day opt-out. These Terms are governed by the laws of the State of Texas; the exclusive venue for any action permitted in court is the state and federal courts in Jefferson County, Texas. Before initiating any proceeding, you and TNM agree to attempt to resolve the dispute informally for at least sixty (60) days after a written Dispute Notice to legal@thetnm.org. Any unresolved dispute will be resolved by binding individual arbitration administered by the American Arbitration Association under the Federal Arbitration Act. If 25 or more substantially similar demands are filed within any 90-day period by coordinated claimants, a mass-arbitration protocol with a 90-day global mediation period and batches of no more than 50 claims applies. You may opt out of this Section by written notice to legal@thetnm.org with the subject line “Arbitration Opt-Out” within thirty (30) days of first accepting these Terms. Carve-outs exist for small-claims actions and for equitable relief to protect intellectual property or stop misuse of the Services.

20. Modifications

TNM may add to, change, suspend, or discontinue any aspect of the Services at any time. TNM may modify these Terms; for material changes (including to Sections 7, 9, 10, 17, 18, or 19), TNM will provide at least thirty (30) days’ advance notice and, where account-gated, require your affirmative acceptance. Continued use after the Effective date constitutes acceptance.

21. Termination; survival; general

Termination ends your right to use the Services but does not extinguish obligations that by their nature survive, including Sections 8, 10, 11, 12, 16, 17, 18, and 19. These Terms, the Privacy Policy, and the Community Guidelines are the entire agreement concerning the Services. If any provision is held unenforceable, the remaining provisions remain in force. Failure to enforce any provision is not a waiver. You may not assign these Terms without TNM’s consent; TNM may assign them. Nothing here creates any agency, partnership, joint venture, or employment relationship. The English version controls.
